ALUARMOR – TERMS & CONDITIONS
1. GENERAL
These Terms and Conditions apply to all purchases made from AluArmor through our website, by quotation or invoice, by telephone or email, or directly from our premises.
By placing an order with AluArmor, the customer agrees to these Terms and Conditions.
Nothing in these Terms and Conditions is intended to exclude, restrict or limit any rights that a consumer may have under the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, or any other applicable South African legislation.
2. PRODUCTS
AluArmor manufactures and supplies vehicle protection and accessory products, including bullbars, front bumpers, rear bumpers and associated components.
Products may be manufactured from aluminium, DOMEX steel or other materials as specified in the applicable product description, quotation or invoice.
We continually develop and improve our products. We therefore reserve the right to make reasonable changes to designs, specifications, materials, components or manufacturing methods, provided such changes do not materially reduce the quality or intended functionality of the product ordered.
3. VEHICLE COMPATIBILITY
AluArmor products are generally designed for specific vehicle makes, models and model years.
Customers must select the correct vehicle when placing an order.
If there is any uncertainty regarding compatibility, the customer should contact AluArmor before ordering.
Vehicle manufacturers may introduce specification or equipment changes during a model year. AluArmor may therefore request photographs, VIN information, vehicle specifications or other reasonable information to confirm compatibility.
AluArmor cannot be held responsible for an incorrect product selection made by the customer where the product supplied correctly corresponds with the vehicle application selected by the customer, subject to applicable consumer law.
4. PRODUCT PHOTOGRAPHS & APPEARANCE
Photographs, renders, drawings and illustrations on our website are intended to provide a reasonable representation of our products.
Minor differences may occur due to product development, manufacturing processes, material batches, powder-coating finishes, vehicle specifications or screen/display differences.
Accessories, lights, recovery equipment or other items shown in photographs are not necessarily included unless specifically stated in the product description, quotation or invoice.
5. MADE-TO-ORDER & CUSTOM PRODUCTS
Certain AluArmor products are manufactured specifically after an order is placed and/or for a particular vehicle application.
Made-to-order or customised products may include:
• Vehicle-specific bullbars
• Front bumpers
• Rear bumpers
• Customer-requested modifications
• Customer-selected colours or finishes
• Special powder-coating requirements
• Products modified to suit customer requirements
• Products manufactured according to customer-supplied information or specifications
Made-to-order, customised and personalised products may be subject to different cancellation and return provisions from ordinary stock products, subject always to applicable South African law.
6. QUOTATIONS & PRICING
All prices are stated in South African Rand (ZAR) unless otherwise specified.
Written quotations are valid for the period stated on the quotation.
The price applicable to an accepted order will be the confirmed price, subject to customer-requested changes, additions or modifications.
Where additional work or products are requested after an order has been confirmed, additional charges may apply.
7. DEPOSITS & PAYMENT
AluArmor may require full payment or a deposit before manufacturing, procurement or preparation of an order commences.
The applicable payment requirements will be stated on the quotation, invoice, order confirmation or website checkout.
Unless otherwise agreed in writing, all outstanding amounts must be paid before collection, dispatch or fitment.
Goods remain the property of AluArmor until payment has been received in full, to the extent permitted by law.
8. CUSTOMER-REQUESTED CHANGES
Changes requested after manufacturing has commenced may result in additional charges and/or an extension of the estimated completion date.
Certain changes may no longer be possible once a particular manufacturing, bending, welding, finishing or powder-coating stage has been completed.
Where applicable, additional charges will be communicated to the customer before additional work proceeds.
9. MANUFACTURING & LEAD TIMES
Manufacturing, completion, fitment and delivery dates provided by AluArmor are estimates unless expressly guaranteed in writing.
AluArmor will make reasonable efforts to meet estimated completion dates.
Delays may occur due to material availability, supplier delays, manufacturing requirements, powder coating, freight, customer-requested changes or circumstances reasonably outside our control.
Where reasonably possible, customers will be informed of significant delays.
10. FITMENT
Where fitment is included in the order, the customer must make the correct vehicle available at the agreed place and time.
Where an AluArmor product is installed by the customer or by an independent third-party installer, the product must be installed correctly and in accordance with any applicable fitment instructions.
Damage caused by incorrect installation, unauthorised modification or improper fitment does not constitute a manufacturing defect.
Nothing in this clause limits statutory rights that cannot lawfully be excluded.
11. VEHICLE SENSORS, CAMERAS & ELECTRONIC SYSTEMS
Modern vehicles may be fitted with parking sensors, cameras, radar, driver-assistance systems, towbar electronics and other electronic equipment.
Customers should advise AluArmor of relevant vehicle equipment when ordering or arranging fitment.
Certain vehicle systems may require adjustment, relocation, calibration or specialist attention following the installation of aftermarket equipment.
Where AluArmor is aware that additional work is required, we will endeavour to inform the customer.
Unless specifically included in the quotation, manufacturer or dealer calibration and third-party specialist services are not automatically included in the product price.
12. TOWING & RECOVERY EQUIPMENT
Where an AluArmor product incorporates or accommodates towing or recovery equipment, the customer remains responsible for ensuring that the vehicle, towbar, recovery equipment and associated components are used within their applicable ratings and manufacturer specifications.
The installation of an AluArmor product does not increase the manufacturer's rated towing, payload or recovery capacity of the vehicle.
13. WARRANTY & DEFECTIVE PRODUCTS
AluArmor stands behind the quality of its workmanship and manufactured products.
If a customer believes that a product has a manufacturing defect, the customer should notify AluArmor as soon as reasonably possible and allow us a reasonable opportunity to inspect and assess the product.
Where a product is found to be defective, the matter will be dealt with in accordance with applicable South African consumer legislation.
Nothing in these Terms and Conditions limits a customer's statutory rights regarding defective, unsafe or unsuitable goods.
14. NORMAL WEAR, DAMAGE & MAINTENANCE
A manufacturing defect does not include ordinary wear and tear or damage caused by:
• Vehicle accidents or collisions
• Off-road impact damage
• Negligent or improper use
• Overloading
• Incorrect recovery procedures
• Unauthorised modifications
• Incorrect installation
• Failure to maintain the product
• Damage to powder coating or surface finishes caused by impact, chemicals or improper care
• Use outside the intended purpose or applicable ratings
• Damage caused by circumstances outside the reasonable control of AluArmor
This provision does not limit statutory rights that cannot lawfully be excluded.
15. POWDER COATING & FINISHES
Powder-coated products should be maintained and cleaned appropriately.
Stone chips, scratches, collision damage, impact damage and damage caused by harsh chemicals or improper cleaning are not manufacturing defects.
Minor variations in colour, texture or finish may occur between different production batches.
If a customer believes a finish is defective due to workmanship or manufacturing, AluArmor should be contacted so that the product can be assessed.
16. COLLECTION & DELIVERY
Collection and delivery arrangements will be handled in accordance with our Shipping & Delivery Policy.
Customers should inspect products upon collection or delivery and report any visible damage as soon as reasonably possible.
17. INTELLECTUAL PROPERTY
All AluArmor product designs, drawings, CAD files, DXF files, manufacturing information, photographs, renders, logos, branding and other proprietary material remain the intellectual property of their respective owner.
They may not be copied, reproduced, distributed, reverse-engineered, manufactured from or commercially exploited without prior written permission.
18. WEBSITE INFORMATION
AluArmor takes reasonable care to ensure that product descriptions, specifications, vehicle applications and prices displayed on our website are accurate.
If an obvious error occurs in a product description, specification, vehicle application or price, AluArmor will contact the customer and provide an opportunity to confirm or cancel the affected order where appropriate and in accordance with applicable law.
19. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, AluArmor will not be responsible for indirect or consequential losses resulting from misuse, incorrect installation, unauthorised modification, accidents or operation contrary to supplied instructions.
Nothing in this clause excludes or limits liability where doing so would be prohibited by South African law.
20. GOVERNING LAW
These Terms and Conditions are governed by the laws of the Republic of South Africa.
Any provision of these Terms and Conditions that conflicts with a mandatory provision of applicable consumer legislation will be interpreted and applied subject to that legislation.
